Where none of the parties is domiciled or has its place of business in Sweden, in a commercial relationship such parties may exclude or limit the application of the grounds for challenge through an express written agreement (see Section 51 of the Arbitration Act). It should be noted that the grounds for invalidity of awards cannot be waived beforehand. The parties are free to agree that an award can be appealed to another instance, including a second arbitral tribunal or a court.
